Foreign nationals employed in India on an employment visa must maintain valid immigration status for the duration of their employment. Where the employment continues beyond the validity of the existing visa, the foreign national may apply for an extension through the Foreigners Regional Registration Office (FRRO) or Foreigners Registration Office (FRO), under the Bureau of Immigration (BoI).
India’s e-FRRO system has moved most of its registration and visa-related formalities online. This can allow foreign nationals to submit applications and supporting documents electronically. It must be noted that India’s FRRO/FRO may require an applicant to appear for an interview or provide additional information during employment visa extension processing.
Employment Visa Support
Assess compensation, tax, payroll, benefits, and compliance costs before extending the employment visa. When can an employment visa be extended?
An employment visa extension application may generally be submitted 15 to 60 days before the expiry of the existing visa.
The extension is subject to the foreign national continuing to meet the applicable employment visa conditions, including the requirements relating to employment in India. Processing procedures and timelines may vary depending on the jurisdiction of the relevant FRRO/FRO.
An employment visa may generally be extended for an additional 12-month period, subject to approval. Under the framework, extensions can permit a foreign national to remain in India for a cumulative period of up to five years from the date of issue of the initial employment visa.
Who can apply for an employment visa extension?
An extension may be considered where the foreign national:
- Continues to be employed by the Indian entity for which the employment visa was issued
- Continues to meet the applicable visa conditions
- Has complied with applicable FRRO/FRO registration and reporting requirements
- Submits the extension application within the prescribed timeframe
An employment visa is generally connected to the employment for which it was issued. Accordingly, changes in employer, employment terms, designation, or other material conditions should be assessed before they are implemented, as they may affect the individual’s immigration status.
Documents required for an employment visa extension
Documentation required for an employment visa extension may vary according to the individual’s circumstances and the requirements of the relevant FRRO/FRO.
Here are some of the employment visa documentation required for an extension:
- Registration form: Three copies of the registration form.
- Employment contract: Three copies of the employment contract from the employer should be prepared. The contract should include relevant employment terms, including the terms and conditions of employment, salary and designation.
- Employer undertaking: An employer should provide three copies of an undertaking letter prepared on company letterhead. The undertaking must be stamped and signed by the appropriate authority within the company.
- Income tax documentation: For foreign nationals who have been living in India for more than one year.
- Permanent Account Number documentation: Three copies of the foreign national’s PAN card or three copies of the PAN application.
In addition to these documents, applicants may need to provide their passport, current employment visa, proof of residence, registration records, and other supporting documents requested by the relevant FRRO/FRO.
Travel during the extension process
Foreign nationals should evaluate their international travel plans carefully while an employment visa extension application is pending.
An expatriate must remain in India from the time the extension application is submitted until the service is granted. Departure from India while the application is being processed can result in the extension application lapsing.
If the foreign national needs to leave India while the extension application is pending and the existing visa has expired, an exit permit/visa may need to be obtained from the FRRO/FRO. A new visa may subsequently be required to return to India.
Accordingly, international travel should be planned around the extension process and the validity of the existing visa.
What happens if the employment visa expires?
An employment visa should not be allowed to expire without the appropriate extension or other immigration action.
Where an extension application has not been submitted before expiry, the foreign national may face additional immigration procedures associated with an expired visa or overstay. The appropriate course of action will depend on the individual’s circumstances and the requirements of the relevant immigration authorities.
Foreign nationals approaching visa expiry should therefore address the extension process in advance and maintain the required employment, registration, and tax documentation.

Key considerations for employers and expats
The foreign national and the Indian employer must coordinate the employment visa extension process. Employers should ensure that employment documents accurately reflect the individual’s current salary, designation, and terms of employment.
Foreign nationals should maintain valid passports, PAN and tax records, FRRO/FRO registration documents, and other immigration records throughout their stay in India.
Applicants should submit extension applications within the applicable timeframe and avoid international travel while an application is pending unless they have confirmed the immigration implications.
Documentation and procedural requirements may vary based on the foreign national’s circumstances and the jurisdiction of the relevant FRRO/FRO. Applicants should confirm the applicable requirements before submitting the extension application.
